Spartanburg Bench Warrant Process
A bench warrant is a process issued from the bench by the judge. It orders law enforcement to arrest the person and bring them to court. This is not an arrest warrant. Arrest warrants stem from investigations. Bench warrants come from the court when a person breaks a promise to appear or pay.
The most common reasons for a bench warrant in Spartanburg are failure to appear at a hearing, failure to pay fines on time, and being tried in absence. When the judge calls a case and the person is not in the courtroom, the judge has the authority to issue a bench warrant right then. The warrant goes into the system the same day.
Under S.C. Code Section 22-5-115, the court can issue a summons as an alternative. A summons sets a new court date and avoids the arrest process. This option is more common for first-time failures to appear. In Spartanburg, repeat offenders are more likely to get a bench warrant than a summons.
Visit the Spartanburg Municipal Court page for current information about court schedules, payment options, and bench warrant procedures.
Note: A bench warrant stays active until the court resolves it. There is no expiration date. Moving away from Spartanburg does not cancel the bench warrant.
Special Programs for Warrants
Spartanburg offers two programs that can help people with bench warrants. The Homeless Court Program is designed for people experiencing homelessness who have accumulated municipal court offenses. This program allows participants to resolve their cases through treatment and services rather than fines or jail time. Successful completion can result in dismissal of charges. If a bench warrant was issued for these types of cases, the Homeless Court Program may provide a path to clearing it.
The 7th Circuit Solicitor also runs a Pre-Trial Intervention program with Bench Warrant Consideration. This program is for eligible offenses and gives qualified defendants a chance to resolve their cases without going to trial. If you have a bench warrant in Spartanburg and believe you may qualify for PTI, contact the 7th Circuit Solicitor's office to ask about eligibility.
These programs reflect Spartanburg's approach to giving people options for resolving bench warrants through constructive steps rather than simply waiting for arrest. Not all cases qualify, but those that do can benefit from reduced penalties or case dismissal.
